The customer declares to have read these conditions and accepted them by checking the box provided before implementing the online ordering procedure. Unless proven otherwise, the data recorded in the MAXIVA GROUP's computer system constitutes proof of all transactions concluded with the customer.

c) The choice and purchase of a product are the sole responsibility of the customer. Product offers are understood within the limit of available stocks, as specified when placing the order.
The products presented on the site are offered for sale worldwide and specifically in countries available at the time of entering your delivery address.
In the case of an order to a country other than France, the customer is the importer of the product(s) concerned.
For all products shipped outside the European Union, the price will be automatically calculated excluding taxes on the invoice.
Customs duties or any other local taxes will be the responsibility and the sole responsibility of the customer.
2) Prices and Shipping Costs
a) Prices indicated on the product presentation pages are exclusive of taxes.
b) Once the customer is registered and their delivery address entered, the VAT rate will be updated as follows:
i) If you are located in France, the French VAT rate will be applied.
ii) If you are located in the European Union, your VAT number will be required for intra-community VAT.
iii) If you are located outside the European Union, we will not collect any VAT.
c) The rates take into account any discounts granted by MAXIVA GROUP; these rates are firm and not subject to revision during their validity period, but MAXIVA GROUP reserves the right, outside the validity period, to change the prices at any time.
d) Prices do not include shipping costs, which are invoiced in addition under the conditions indicated on the site and calculated prior to placing the order.
The payment requested from the customer will correspond to the total amount of purchases, including shipping costs.
3) Orders
a) Product offers are valid as long as they are visible on the site, within the limits of available stocks.
The sale will only be considered valid after full payment of the price. It is the customer's responsibility to check the accuracy of the order before payment. Once the order is paid and being prepared, it cannot be modified or canceled and will be shipped.
Any order placed on the site constitutes the formation of a distance contract between the customer and MAXIVA GROUP.
MAXIVA GROUP reserves the right to cancel or refuse any order from a customer with whom there is a previous dispute.
The customer can track the progress of their order on the site from their customer space and will be informed by email at each stage of their order.
4) Payment
a) Payment can be made according to the following methods:
i) Payment by bank transfer (details are provided when finalizing the order)
b) In the case of payment by bank transfer, the products will be set aside and reserved for 7 days to give the customer time to make the transfer.
c) Be sure to include your order number in the comments of the bank transfer to facilitate and expedite the processing of your order.
5) Shipments and Deliveries
a) We ship all orders within 72 hours (excluding weekends and public holidays). In the event that the customer orders an out-of-stock product, their order will be shipped all at once as soon as MAXIVA GROUP has all the ordered products available.
b) Orders are handed over to carriers in neutral and discreet packaging.
c) Orders over €10000 excluding shipping costs may take an additional 24 to 72 hours to be shipped.
d) Deliveries are made by an independent carrier to the address mentioned by the customer when placing the order and to which the carrier can easily access.
If the customer enters an invalid or incorrect address, the address cannot be changed or corrected. The inability to properly deliver the package will then be entirely the customer's responsibility.
e) The delivery times indicated on our site are indicative by our various carriers, so it will not be possible to make a claim for non-compliance with these deadlines (except for the carrier Chronopost).
6) MAXIVA GROUP's Liability and Guarantees
a) The legal warranty applies according to legal provisions. The additional commercial warranty is not affected.
b) We exclude our liability in case of negligence to the extent that the essential obligations of the contract are not affected. The same principles apply to our principals.
c) Our liability cannot be engaged in the following cases:
i) Non-compliance with the legislation of the country in which the products are delivered, which is the customer's responsibility to verify.
ii) In the event of misuse, negligence, or maintenance by the customer, as well as in the case of normal wear and tear of the product, accidents, or force majeure.
iii) The photographs and graphics presented on the site are not contractual and cannot engage our liability.
7) Personal Data
a) The customer is informed that the collection of their personal data is necessary for the sale of products and their delivery, entrusted to MAXIVA GROUP. This personal data is collected solely for the execution of the sales contract.
b) The collected data will be kept by MAXIVA GROUP for 5 years, covering the time of the prescription of legal contractual civil liability.
c) Unless the customer expresses their agreement, their personal data will not be used for advertising or marketing purposes.
d) MAXIVA GROUP implements organizational, technical, software, and physical measures in terms of digital security to protect personal data against alterations, destruction, and unauthorized access.
e) The customer, in accordance with the regulations applicable to personal data, can request to update or delete the data concerning them by sending an email to [email protected] or via their customer account.
MAXIVA GROUP will have a period of 1 month to process the customer's request.
8) Intellectual Property
a) The content of the site https://poppers-distribution.com/ is the property of MAXIVA GROUP and its partners and is protected by French and International laws relating to intellectual property.
b) Any total or partial reproduction of this content is strictly prohibited and may constitute an offense of counterfeiting.
9) Applicable Law and Language
a) If a provision of the general conditions or a provision within the framework of any other agreement between MAXIVA GROUP and the customer were null or became null, the other provisions of these general conditions or other agreements would not be affected.
b) These general conditions and the operations arising from them are governed by and subject to French law.
c) These general conditions are written in the French language. In the event of translation into one or more foreign languages, only the French text would prevail in the event of a dispute.
